In these Terms and Conditions (Terms), “we”, “our”, or “us” refer to Tummah Ethical Trade Limited; and “you” or “your” means you, the customer. These Terms and Conditions, along with our Privacy Policy and our Delivery and Returns Policy regulate the business relationship between you and us. By browsing, accessing and using this website, you agree to be bound by our Terms, which shall take effect immediately on your first visit to our website.

Our Terms do not restrict your personal rights under the Consumer Guarantees Act 1993.

If you do not agree with our Terms, please do not use our website.

Minimum age

By placing an order (and thus accepting our Terms), you warrant that you are at least 18 years old or have your parents’/ caregivers’ permission to buy from us.

New Zealand business (and governing law)

Tummah Ethical Trade Limited is a New Zealand owned and operated business and all prices on our website are in New Zealand dollars. The goods for sale on this website are intended only for people living in New Zealand, and you will only be able to enter a New Zealand based address for billing and shipping. These Terms are governed by New Zealand law. This extends to contracts between you and us for the purchase of goods, and any disputes or claims arising from these contracts. By agreeing to our Terms, you agree that all matters or disputes connected to this website will be dealt with in New Zealand courts.

Placing an order

Please make sure you read and understand these Terms before placing any orders on our website. To remove any doubt as to your agreement to our Terms when purchasing from us, you will be prompted to accept our Terms before placing any order (with a tick box). If you do not accept our Terms and Conditions, you will be unable to place an order with us. By checking the box and subsiquently placing your order, you agree that these Terms will apply to any sales contract between us; and confirm that you have read and understood them, and agree to be bound by them.

When you place an order on our website you will be assisted through the checkout process. During this process, you can review, confirm or correct your order prior to finally submitting it. When you place an order, you are making an offer to us to purchase the goods you have selected based on our Terms. An order confirmation email will be sent and you will be issued with an order number. However, receipt of this order confirmation email does not constitute our acceptance of your order. Our acceptance of your order is not confirmed until we send you an email confirming shipment of the goods you have ordered. If after payment is received we cannot accept your order or process the entirety of your order, we will contact you by email or telephone.

Any contract is between you and us. No other person shall have any rights to enforce any of its Terms.

Payment of your order

The name that will appear on your statement will be TUMMAH ETHICAL TRADE.

We offer 3 different payment options on our website. The first option is PayPal, a well regarded payment provider. You will be directed to the PayPal page to pay with your PayPal account (if you have one). There is also an option to pay with credit card, but we have the eWAY payment option for credit card payments.

The second is POLi. POLi is an unique option that allows you to pay through your internet banking, there is no need for a credit card. POLi is totally secure, and there is a link in the checkout to their page with more information about how the POLi payment option works.

Lastly, there is eWAY. eWAY is a well respected payment provider used by many New Zealand business. When paying by credit card on the checkout page, you will be using eWay. Although you remain on our checkout page, the payment form is completely hosted by eWay and we have no access to any credit/debit card details entered or saved during this process.

Products

At Tummah Ethical Trade we take pride in the products we choose to stock. All information is provided in good faith, and we have taken great care to ensure the information is correct and up to date. Unfortunately, we are unable to guarantee that all details, including product descriptions and images on our website, are correct at the time of publishing.

In regards to images, we cannot guarantee that your computer monitor’s display of any colour will be accurate. The products you receive may vary slightly from these images and descriptions.

All products are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available. Product information and availability is subject to change without notice.

Prices

Prices for our products may change from time to time. Price changes will not affect any orders which we have confirmed (through dispatch confirmation – as mentioned under “Placing an order”).

Despite our best efforts, there is always the small possibility that some of our products on our website may have an incorrect price. If we do find an error with a price, we will update that price immediately. In this situation, there is a pricing error on a product you have ordered, we will contact you in writing (through email) of this error before accepting your order. If the products correct price is lower than the purchase price, you will be charged the lower price. If the correct price is higher than the purchase price, then we reserve the right to change the price. As we strive to put customers first, in the case of any such error we will change the price back to the correct price less 10%; as an apology to you. You will then have the option of continuing the purchase at the correct price (less 10%), or cancelling the order. In any case, we will wait for your instruction before proceeding.

Limitation of liability

To the extent permitted by law:

  • Tummah Ethical Trade disclaims all warranties, representations, and guarantees with respect to any product or information supplied, including but not limited to; fitness for a particular purpose, accuracy, availability, timeliness, or completeness.
  • Tummah Ethical Trade’s liability for any claim, loss, or damage related to a product supplied is limited to the cost paid by you for the product.
  • Tummah Ethical Trade will not be liable whether in contract, tort (including negligence) or otherwise for any loss of profits, or any direct, indirect, special, or consequential damage, loss, or injury of any kind suffered or incurred by you in connection with your access to, or reliance upon this website or the content on or accessed through it.

You may have statutory rights and remedies for products that are subject to the Consumer Guarantees Act 1993. This provision and no other provision in our Terms exclude or limit your rights under the Consumer Guarantees Act 1993.

This website and its contents such as text, logos and images, is subject to copyright; and is the property of Tummah Ethical Trade, or our content suppliers. The content on this website may not be used in any way without our prior written consent.

Discount codes

  • Only one discount code can be used per order.
  • Discount codes can be used on products that are already on sale.
  • Discount amounts are applied before shipping costs (free shipping over $75).
  • Most discount codes can only be used once. There may occasionally be exceptions to this rule, and you will be notified in an email if you can use a code multiple times.
  • Discounts codes may have an expiry date. Orders placed outside these dates will be sold at full price.

Waitlist

For products that are temporarily out of stock, or yet to arrive for the first time, you will be able to join our waitlist. It is our policy to contact you when the product comes into stock, to confirm that you still want to go ahead with the purchase. If we cannot get in contact with you for 3 days, it will be implied that you no longer want to be on the waitlist and you will be removed.

If there is a short shipment, people on the waitlist will be prioritised on a first placed, first served process. If a waitlisted product is not available for any reason (e.g. supplier out of stock/ discontinued), or you miss out due to being low on the list when there is a short shipment, we will notify you via email.

For new products, we will provide an expected arrival date. Please note that this is an estimate only, not a guarantee. If there is any delay with delivery, you will be notified.

Third party links

Occasionally we may include links on our website to external sites which we believe you will find useful. These third-party sites have separate and independent privacy policies and we therefore cannot be held responsible for the protection of privacy of any information you provide whilst visiting such sites. We encourage you to exercise caution and look at their privacy policy before entering any information.

The terms set out in our Privacy Policy cover the domain name of Tummah Ethical Trade Limited. Nonetheless, we seek to protect the integrity of our website and welcome any feedback about these linked third-party sites.

Our Privacy Policy is split into three sections – the main Privacy Policy (regarding information we collect from you), information about Cookies on the website, Payment Information (who have access to this). Termination of relationship

We reserve the right to terminate our agreement with you and prevent any further relationship with you if you breach these Terms.

Other important terms

Each of these Terms operate separately. Therefore, if any of these Terms are deemed to be void, unlawful or unenforceable by any court or relevant authority, the remaining Terms will remain in full force and effect.

If we fail to enforce any of these Terms against you, or if we delay in doing so; we have not waived our rights in relation to that term, nor have we waived our rights to later enforce that or any other term.

Changes to our terms

We reserve the right to amend these Terms, and may do so from time to time. We will notify users by stating that our Terms have been amended on this page. You should check and read these Terms regularly, as by continuing to access this website, you are deemed to have agreed to the amended Terms.
